BetterHomePro — Contractor Terms of Use

These Terms of Use govern your access to and use of BetterHomePro (pro.betterhomequotes.com), operated by Orys Consulting LLC. By creating an account or purchasing leads, you agree to be bound by these Terms.

1. Description of Services

BetterHomePro is a lead generation platform operated by Orys Consulting LLC. We generate inbound leads from homeowners requesting home service quotes and deliver those leads to licensed contractors who have contracted with us to receive them.

2. Eligibility

To use BetterHomePro you must:

  • Be a licensed and insured home service contractor in good standing in your operating jurisdiction
  • Have a minimum Google rating of 4.0 with at least 20 reviews
  • Operate in a metro area of at least 200,000 people
  • Have a dedicated person available to receive and respond to leads during business hours
  • Have an average job value of at least $2,000

We reserve the right to verify your credentials and to decline or terminate any account that does not meet these standards.

3. Lead Types

  • Exclusive Leads — Delivered to one contractor only. Your information is not shared with any other contractor for that specific lead.
  • Non-Exclusive Leads — Delivered to a limited number of contractors simultaneously. You will be informed of the non-exclusive nature of these leads before purchase.
  • Second Chance Leads — Previously delivered non-exclusive leads that were not closed within 30 days. Sold in bulk at a reduced rate. These leads have been previously contacted by other contractors.

The lead type applicable to your account will be specified in your service agreement or at the time of purchase.

4. Payment Terms

Leads are prepaid on a weekly basis. You pay for the coming week's leads before delivery begins. We do not deliver leads without advance payment.

Payment may be made via:

  • Stripe payment link
  • Direct invoice
  • Credit card or ACH through our contractor portal

A one-time setup fee applies to new accounts and covers CRM buildout, automations, tracking number, and landing page setup. This fee is non-refundable once setup has been initiated.

Late or failed payments will result in immediate suspension of lead delivery until the balance is resolved.

5. Lead Quality and Replacement Policy

We deliver leads that include a verified full name, valid phone number, confirmed service address within your geography, and a specific service request.

A lead replacement will be issued if:

  • The phone number is completely unreachable after three documented call attempts within 24 hours of delivery
  • The lead is a duplicate of one delivered to you within the past 90 days
  • The contact information is demonstrably false or invalid

Replacement requests must be submitted within 48 hours of lead delivery with supporting documentation, including timestamped call logs. Replacements are capped at 10% of your weekly lead batch.

The following do not qualify for replacement:

  • Lead did not close or purchase
  • Lead received a quote from a competitor
  • You contacted the lead more than 24 hours after delivery
  • Lead was not ready to move forward immediately
  • Lead did not meet your personal preference

6. Your Responsibilities as a Contractor

By using BetterHomePro you agree to:

  • Contact every lead within 30 minutes of delivery during business hours
  • Log lead status and disposition in the CRM provided
  • Comply with all applicable laws including TCPA, state telemarketing laws, and consumer protection regulations
  • Maintain your license, insurance, and credentials in good standing throughout the duration of your account
  • Not resell, redistribute, or share lead information with any third party without our prior written consent
  • Treat homeowner information as confidential and use it solely for the purpose of providing home service quotes
  • Not use lead information for any purpose unrelated to the service requested by the homeowner

7. Exclusivity and Market Availability

We operate one active campaign per market per trade. Where exclusive leads are offered, we commit to delivering that lead to only one contractor.

Market availability is not guaranteed. We reserve the right to determine market boundaries and to add or remove markets at our discretion. If your market becomes unavailable, we will notify you and suspend billing until an alternative arrangement is made.

8. No Guarantee of Results

We do not guarantee lead conversion rates, close rates, revenue, or any specific business outcomes. Lead performance depends on factors outside our control including your sales process, response time, pricing, and local market conditions.

9. Cancellation

You may cancel your account with one week's written notice to [email protected]. The final prepaid week will run to completion. No partial refunds are issued for unused leads in a prepaid week unless delivery fell short of the agreed minimum, in which case the shortfall rolls to the following week or a prorated credit is issued.

We reserve the right to terminate any account at any time for violation of these Terms, failure to meet eligibility requirements, or conduct detrimental to homeowners or to the integrity of our platform.

10. Intellectual Property

All systems, campaigns, ad creatives, landing pages, tracking infrastructure, and CRM configurations built by Orys Consulting LLC remain the property of Orys Consulting LLC. Upon account termination, you retain access to your own business data but not to any infrastructure built and owned by us.

11. Limitation of Liability

To the fullest extent permitted by law, Orys Consulting LLC is not liable for any indirect, incidental, or consequential damages arising from your use of BetterHomePro or from lead performance. Our total liability for any claim shall not exceed the amount you paid to us in the 30 days preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Orys Consulting LLC and its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of lead information, your violation of these Terms, or your violation of any applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the state in which Orys Consulting LLC is registered. Disputes will be resolved through binding arbitration except where prohibited by law. You waive the right to participate in class action proceedings.

14. Modifications

We may update these Terms at any time. We will notify active accounts of material changes by email. Continued use of BetterHomePro after changes are posted constitutes acceptance of the updated Terms.
